Matchvent App – Terms and Conditions

By creating an account on Matchvent, the user is bound by the following:

• Privacy Policy
• Terms of Use/ Terms and Conditions

If you do not accept and be bound by all the terms of this agreement, do not use this service.

The above terms may be amended. You will be notified in advance (through notification through the app or by email) to changes if there are material changes to your rights. You should not use the Matchvent app if you do not agree with the amendments made. Furthermore, it is your obligation to continuously monitor matchvent.com for changes to the terms. Continuing to use the app constitutes agreement with the amendments made. 

To create an account with Matchvent you must be at least 18 years of age. Furthermore, you represent and warrant that:

• you can form a binding contract with Matchvent,
• you have the legal ability to understand and accept these terms
• you are not a person who is barred from using the Service under the laws of the United States or any other applicable jurisdiction (for example, you do not appear on the U.S. Treasury Department’s list of Specially Designated Nationals or face any other similar prohibition),
• you will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations, and
• you have never been convicted of a felony or indictable offense (or crime of similar severity), a sex crime, or any crime involving violence, and that you are not required to register as a sex offender with any state, federal or local sex offender registry.

You are responsible for always keeping your login details confidential. You should not share or expose your password to others. You are solely responsible for all activity that happens under your login details. You should contact matchvent immediately in the case that you believe that someone might have access to your account.

The Matchvent service may be modified and even terminated at any time. You will not be notified prior to this unless this materially affects your rights or obligations.

You may terminate your account at any time by sending an email requesting this to support@matchvent.com. In case of breach of these terms or other type of misconduct, Matchvent reserves the right to terminate your account without prior notice. You should not use the Servive with malicious intent, in a way that breaches this agreement, in a way that scams or defrauds other members of the service. Furthermore, sexually explicit or pornographic content is not allowed on the service and may result in the termination of your account if such content is shared. Furthermore, requesting money from other members is strictly prohibited. Matchvent also reserves the right to terminate your account without prior notice in case the way you interact with other members is offensive, threatening, harassing, stalking, bullying, intimidating, mistreating, defamatory. 

Matchvent is not responsible for the conduct of any member on the Service, off the service or during events. Users are responsible for exercising caution when using the service online and in events and in any scenario where they meet in person.

You agree to release Matchvent from any claims, rights, losses, demands, and actions of any kind includingdeath, property damage and personal injuries that either directly or indirectly arises from your interactions with the app or with users of the app. If you are a California resident, you hereby waive California Civil Code Section 1542, which states, “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” The foregoing release does not apply to any claims, demands, or any losses, damages, rights and actions of any kind, including personal injuries, death or property damage for any unconscionable commercial practice by Matchvent or for such party’s fraud, deception, false, promise, misrepresentation or concealment, suppression or omission of any material fact in connection with the App.

You should further not use the service in a way that negatively impacts the performance of the servers. You should also not use bots, crawlers, scrappers, or any other way that automates the use of the app or collects user data.

By creating an account, you grant to Matchvent a worldwide, transferable, sub-licensable, royalty-free, right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify and distribute information you post, upload, display or otherwise make available on the Service or transmit to other members, as necessary for the correct functioning of the app. Matchvent’s license to your Content shall be non-exclusive, except that Matchvent’s license shall be exclusive with respect to derivative works created through use of the Service.  You further agree that information you post, upload, display or otherwise make available on the Service or transmit to other members may be viewed by any of the users of the Service and can also be shared by someone using the service with someone outside the service.

You agree that all the personal information you provide Matchvent is truthful and non-deceptive and that you are not impersonating any other person or using their pictures.

As part of our goal to protect our users, we may monitor users accounts and communications with other members to ensure a safe environment for all. You therefore aggree that Matchvent may monitor and review any content that you provide to the service, including your profile and any communication between members. You also agree that your account may be terminated without prior notice in case it is found or is suspected that you have breached these terms or for any other type of misconduct or action that may harm the reputation of Matchvent. You also agree that you will not have more than one account for the service or share your account with someone else. You further agree that you will not make a new account in the case where your account has been terminated by Matchvent. You also agree that your account may be terminated for the reasons detailed in this agreement, whether these reasons are identified on or off the platform (such as in events for example).

Please be informed that Matchvent may access, store and disclose your account information and Content if required to do so by law, by performing its agreement with you, or in a good faith belief that such access, storage or disclosure satisfies a legitimate interest, including to: (i) comply with legal process; (ii) enforce the Agreement; (iii) respond to claims that any Content violates the rights of third parties; (iv) respond to your requests for customer service; or (v) protect the rights, property or personal safety of Matchvent or any other person.

Although the Matchvent team works hard to keep the community along the guidelines of this agreement, Matchvent cannot guarantee that all user content within the Service will comply with the above agreement (although the behavior of each user is their sole responsibility). If you therefore see any content that breaches this agreement, please contact matchvent at support@matchvent.com or report that user using the button in their chat page.

YOU UNDERSTAND THAT MATCHVENT IS SIMPLY A SERVICE TO ALLOW PEOPLE ATTENDING AN EVENT TO MATCH AND CHAT. A CHAT FOR USERS IS INITIATED BY MATCHVENT IN THE SERVICE ONLY AFTER BOTH USERS HAVE EXPRESSED INTEREST IN EACHOTHER. MATCHVENT CANNOT HOWEVER GUARANTEE THE COMPATIBILITY OF THE USERS THAT HAVE BEEN MATCHED. FURTHERMORE, YOU UNDERSTAND THAT MATCHVENT IS IN NO WAY AFFILIATED WITH ANY THIRD-PARTY VENUES THAT HOST EVENTS. MATCHVENT IS THUS NOT IN ANY WAY RESPONSIBLE FOR THE BEHAVIOUR OF ANYONE OF ITS MEMBERS AT ANY VENUE. VENUES WHERE EVENTS LISTED ON THE MATCHVENT PLATFORM ARE HELD ARE IN NO WAY ENDORSED BY MATCHVENT AND USERS SHOULD ABIDE BY THE AGREEMENTS AND RULES OF THESE VENUES IN CASE THEY WANT TO PARTICIPATE IN THOSE EVENTS. MATCHVENT IS IN NO WAY RESPONSIBLE FOR ANYTHING THAT HAPPENS IN THESE EVENTS. IT IS YOUR SOLE RESPONSIBILITY TO RESEARCH AND ASSESS EVENTS PRIOR TO ATTENDING THEM AS NO BACKGROUND CHECKS AND RESEARCH IS PERFORMED BY MATCHVENT FOR EVENTS LISTED IN ITS PLATFORM.   MATCHVENT DOES NOT CURRENTLY PERFORM CRIMINALL BACKGROUND CHECKS ON ANY OF ITS MEMBERS. MATCHVENT ALSO DOES NOT ATTEMPT TO VERIFY THE AUTHENTICITY OF INFORMATION PROVIDED BY ITS USERS. IT IS THUS THE SOLE RESPONSIBILITY OF THE USER TO EXERCISE CAUTION WHEN INTERACTING WITH OTHER USERS IN ANY SETTING, INCLUDING WHEN CHATTING ON THE APP OR OFF THE APP AND MEETING IN PERSON WHETHER THAT IS IN A MATCHVENT EVENT OR IN ANY OTHER SETTING. NOTE THAT DESPITE THIS MATCHVENT RESERVES THE RIGHTS TO PERFORM CRIMINAL BACKGROUND CHECKS ON ANY OF ITS USERS.

YOU UNDERSTAND THAT MATCHVENT IS SIMPLY A SERVICE TO ALLOW PEOPLE TO MATCH AND CHAT. 

If you find that your content has been used on the service in a way that constitutes copyright and personal data infringement, you can contact  support@matchvent.com and request for a takedown.

MATCHVENT PROVIDES THE SERVICE ON AN “AS IS” AND “AS AVAILABLE” BASIS AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICE (INCLUDING ALL CONTENT CONTAINED THEREIN), INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. MATCHVENT DOES NOT REPRESENT OR WARRANT THAT (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR FREE, (B) ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED, OR (C) THAT ANY CONTENT OR INFORMATION YOU OBTAIN ON OR THROUGH THE SERVICE WILL BE ACCURATE.

MATCHVENT TAKES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU OR ANOTHER MEMBER OR THIRD PARTY POSTS, SENDS OR RECEIVES THROUGH THE SERVICE. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MATCHVENT, ITS AFFILIATES, EMPLOYEES, LICENSORS OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE, (II) THE CONDUCT OR CONTENT OF OTHER MEMBERS OR THIRD PARTIES ON, THROUGH, OR FOLLOWING USE OF THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR CONTENT, EVEN IF MATCHVENT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL MATCHVENT’S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF THE AMOUNT PAID, IF ANY, BY YOU TO MATCHVENT FOR THE SERVICE AND USD100 WHILE YOU HAVE AN ACCOUNT.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.

You also agree, to the extent permitted under applicable law, to indemnify, defend and hold harmless Matchvent, our affiliates, and their and our respective officers, directors, agents, and employees from and against any and all complaints, demands, claims, damages, losses, costs, liabilities and expenses, including attorney’s fees due to, arising out of, or relating in any way to your access to or use of the Service, your Content, or your breach of this Agreement.

If any provision of this Agreement (including Terms and Conditions, Privacy Policy and Cookie policy) is held invalid, the remainder of this Agreement shall continue in full force and effect. The failure of the Company to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. You agree that your Matchvent account is non-transferable and all your rights to your account and its Content terminate upon your death. No agency, partnership, joint venture, fiduciary or other special relationship or employment is created as a result of this Agreement and you may not make any representations on behalf of or bind Matchvent in any manner.
